Welcome to Kemya Health. These Terms & Conditions (“Terms”) govern your access to and use of the Kemya Health website, online forms, services, communication tools, and related digital services collectively referred to as the “Website” or “Services.”
By accessing or using this Website, submitting information, placing an order request, booking a consultation, or communicating with us, you agree to be bound by these Terms. If you do not agree, please do not use the Website or Services.
1. About Kemya Health
Kemya Health is an online health platform designed to help patients access information, submit medication-related requests, connect with healthcare providers where applicable, and arrange prescription fulfillment through licensed Canadian pharmacy services.
Kemya Health is not a substitute for medical advice, diagnosis, or treatment from a licensed healthcare provider.
Prescription medications are only provided where legally permitted and only after a valid prescription has been issued by an authorized Canadian prescriber and accepted by a licensed pharmacy.
Pharmacy dispensing and fulfillment services may be provided by Chilliwack Pharmacy, located in British Columbia, Canada, or another licensed Canadian pharmacy partner, where applicable.
2. Eligibility
By using the Website, you confirm that:
- You are at least the age of majority in your province or territory of residence, or you are using the Website with the involvement of a parent or legal guardian.
- You are located in Canada, unless otherwise approved by us.
- The information you provide is accurate, complete, and up to date.
- You are using the Services for yourself, or you are legally authorized to act on behalf of the patient.
- You will not use the Website for any unlawful, fraudulent, abusive, or misleading purpose.
We reserve the right to refuse service, cancel a request, or suspend access if we believe these Terms have been violated or if providing the Service would be unsafe, inappropriate, or unlawful.
3. Not for Emergencies
Kemya Health is not an emergency medical service.
Do not use this Website if you are experiencing a medical emergency, severe symptoms, chest pain, difficulty breathing, signs of stroke, severe allergic reaction, suicidal thoughts, or any urgent medical concern.
For emergencies, call 911 or go to the nearest emergency department immediately.
4. Medical Information and No Guarantee of Treatment
Any information provided on the Website is for general informational purposes only and does not replace professional medical advice.
Submitting an online form, questionnaire, consultation request, refill request, transfer request, or order request does not guarantee that:
- A prescription will be issued.
- A medication will be dispensed.
- A healthcare provider will determine that treatment is appropriate.
- A pharmacy will accept or fill a prescription.
- A specific medication, strength, quantity, formulation, or price will be available.
A licensed healthcare provider and/or pharmacist may determine that a treatment is not appropriate based on your health history, medications, allergies, contraindications, safety concerns, provincial rules, or professional judgment.
5. Prescription Requirement
Prescription medications require a valid prescription from a licensed Canadian prescriber.
Kemya Health does not sell or dispense prescription medications without a valid prescription.
Where a telehealth option is available, the healthcare provider is independent and is responsible for assessing whether a prescription is appropriate.
The final decision to prescribe rests with the prescriber. The final decision to dispense rests with the pharmacist.
6. Telehealth and Third-Party Healthcare Providers
Kemya Health may provide links or access to independent third-party healthcare providers, telehealth clinics, booking systems, or consultation services.
These third-party providers are independent from Kemya Health unless expressly stated otherwise. Their services may be subject to their own terms, privacy policies, fees, availability, professional obligations, and provincial licensing requirements.
Kemya Health does not guarantee that:
- A telehealth appointment will be available.
- A consultation will be covered by provincial health insurance.
- A prescription will be issued.
- A provider will accept you as a patient.
- A provider will send a prescription to a specific pharmacy.
You are responsible for reviewing the terms, fees, and policies of any third-party provider before using their services.
7. Pharmacy Fulfillment
Prescription fulfillment may be completed by Chilliwack Pharmacy or another licensed Canadian pharmacy partner, where applicable.
The dispensing pharmacy is responsible for verifying the prescription, reviewing clinical appropriateness, performing pharmacist assessment where required, counselling the patient, and complying with applicable pharmacy laws, standards, and professional obligations.
Orders may be refused, delayed, or cancelled if:
- The prescription is invalid, expired, unclear, incomplete, altered, or not legally acceptable.
- The medication is unavailable or backordered.
- The pharmacist determines that dispensing may be unsafe or inappropriate.
- Required patient information is missing.
- Payment cannot be processed.
- Delivery cannot be safely completed.
- The request does not comply with applicable laws or professional standards.
8. Patient Responsibility
You agree to provide accurate and complete information, including but not limited to:
- Legal name and date of birth.
- Contact information.
- Shipping address.
- Health card or identification information, where required.
- Medical history.
- Allergies.
- Current medications.
- Relevant medical conditions.
- Pregnancy or breastfeeding status, where applicable.
- Any information requested by a healthcare provider or pharmacist.
You are responsible for reading all medication labels, instructions, warnings, and patient information provided with your medication.
You should contact a pharmacist, prescriber, or other healthcare professional if you have questions about your medication.
9. Medication Safety
You agree not to use medication in a way that differs from the directions provided by your prescriber or pharmacist.
You should not share, resell, transfer, or provide your medication to another person.
You must notify the pharmacy, prescriber, or a healthcare professional if you experience side effects, worsening symptoms, allergic reactions, or unexpected health changes.
10. Compounded Medications
Some medications may be compounded where appropriate and legally permitted.
Compounded medications are prepared specifically for an individual patient based on a valid prescription.
They may not be identical to commercially manufactured products and may have different appearance, packaging, beyond-use dates, storage requirements, or instructions.
Compounded medications may not be returnable or refundable once prepared, except where required by law or where there is a verified pharmacy error.
11. Pricing and Payment
Prices shown on the Website may include medication cost, dispensing fees, service fees, consultation-related fees, shipping fees, or other charges, depending on the product or service.
Prices are subject to change without notice. Displayed pricing does not guarantee availability or eligibility.
Payment may be collected by Kemya Health, Chilliwack Pharmacy, or another authorized payment processor or fulfillment partner.
The payment descriptor on your bank or card statement may show the name of the pharmacy, fulfillment provider, payment processor, or related business entity.
You agree to pay all applicable charges, including medication costs, service fees, shipping fees, taxes, and any other fees disclosed before payment.
12. Insurance and Reimbursement
Kemya Health does not guarantee that any medication, consultation, service, or fee will be covered by provincial health insurance, private insurance, employer benefits, or any third-party payer.
You are responsible for confirming your own insurance coverage and reimbursement eligibility.
Where direct billing is available, coverage is not guaranteed and may be subject to insurer rules, plan limitations, prior authorization, deductibles, or rejection.
13. Shipping and Delivery
Delivery may be available within Canada where permitted by law and where the dispensing pharmacy can safely and appropriately arrange delivery.
Estimated delivery times are not guaranteed.
Delays may occur due to prescription verification, clinical review, payment processing, inventory availability, weather, courier delays, address errors, cold-chain requirements, or other circumstances outside our control.
You are responsible for providing a complete and accurate delivery address and ensuring that someone is available to receive the package where required.
Some medications may require special handling, temperature control, tracking, signature, or other delivery safeguards.
Risk of loss may pass to you once the medication has been delivered to the address provided, subject to applicable law and pharmacy delivery standards.
14. Returns, Refunds, and Cancellations
Due to safety, legal, and professional requirements, prescription medications generally cannot be returned or resold once dispensed or released from pharmacy control.
Refunds may not be available for:
- Dispensed prescription medications.
- Compounded medications already prepared.
- Completed consultations.
- Shipping charges after shipment has occurred.
- Patient-submitted incorrect information.
- Missed appointments or late cancellations, where applicable.
A refund or replacement may be considered if there is a verified billing error, dispensing error, shipping issue, duplicate charge, or other issue that we determine qualifies for correction.
15. Transfer Requests and Refill Requests
The Website may allow you to submit pharmacy transfer requests, refill requests, or prescription-related requests.
Submitting a request does not guarantee that the medication can be transferred, refilled, or dispensed.
Transfers and refills depend on prescription validity, remaining refills, prescriber authorization, pharmacy verification, patient eligibility, and applicable laws.
16. Identity Verification
We may request identification, health card information, contact verification, or other information to confirm your identity, prevent fraud, verify prescription eligibility, or comply with legal and professional obligations.
Failure to provide required verification may result in cancellation or delay of your request.
